We reserve the right to decline any enquiry or engagement at our discretion.

Our Results Guarantee

For all other services — including paid advertising management and website design and development — any guarantee of results or deliverables is only applicable if explicitly stated in writing by TNY Marketing in a signed contract. No guarantee is implied for these services unless clearly specified.

All guarantees are void if the client fails to meet their obligations as outlined in Section 6, including but not limited to withholding access, failing to implement agreed changes, or making unauthorised modifications to assets we manage.

Payment Terms

Payment terms will be specified in your individual contract. Unless otherwise agreed in writing:

• Invoices are due upon receipt or as stated in the contract
• Late payments may result in work being paused until the account is settled
• We reserve the right to charge interest on overdue invoices at the statutory rate
• All fees are exclusive of VAT where applicable

Refund Policy

TNY Marketing does not issue refunds for services rendered. Given the nature of our work and the results guarantee we offer, refunds are not a standard part of our service model.

A refund will only be issued if it is explicitly stated and agreed upon in a signed written contract between TNY Marketing and the client. No other verbal or informal agreement regarding refunds will be honoured.

Client Responsibilities

To allow us to deliver results, clients are expected to:

• Provide timely access to required accounts, platforms, and information
• Implement any recommended changes to their website or Google Business Profile as agreed
• Not make unauthorised changes to assets, profiles, or settings under our management without prior notice
• Respond to communications within a reasonable timeframe
• Ensure all information provided to us is accurate and up to date

Failure to meet these responsibilities may affect our ability to deliver results and may affect the applicability of our guarantee.

Any free guides, templates, calculators, or resources made available by TNY Marketing are provided for informational purposes only. They do not constitute professional advice, and results may vary based on your specific business circumstances, location, and market conditions.

Intellectual Property

All content, guides, templates, methodologies, strategies, and materials produced by TNY Marketing remain the intellectual property of TNY Marketing unless explicitly transferred in writing.

Limitation of Liability

To the fullest extent permitted by law, TNY Marketing shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of our services or resources, including but not limited to loss of revenue, loss of profit, or loss of business opportunity.

Our total liability to you in connection with any services shall not exceed the total fees paid by you to TNY Marketing in the three months preceding the claim.

We do not guarantee specific rankings, traffic levels, or revenue outcomes beyond what is expressly agreed in a signed contract.

Termination

Either party may terminate a service agreement in accordance with the notice period specified in the relevant contract. Upon termination, all outstanding invoices become immediately due. Any work completed up to the point of termination will be charged accordingly.

We reserve the right to terminate our services immediately if a client engages in conduct that is abusive, fraudulent, or in breach of these terms.

Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

We may update these Terms and Conditions from time to time. The latest version will always be available on our website. Continued use of our services after any changes constitutes your acceptance of the updated terms.
